Disability Tax Credit?

I am already receiving the Disability Tax Credit for CPP. It was mentioned to me that my income is so low that my husband would be able to claim this Tax Credit. Would/could someone please inform me as to the benefits if any there would be to this. This is new for both of us in our 60s and just married the end of 2006 and wondering how to proceed. Thank you for any assistance.

First, you say that you receive the disability tax credit for CPP. I assume that you mean you are receiving CPP Disability benefits. this is different then the Disability Tax Credit for income taxes, and receiving the one does not necessarily mean you qualify for the other.





However, assuming that you qualify for the tax credit, then this credit can be transferred to your spouse assuming that your income is low enough that you do not utilize it.





The credit in 2007 is $6,741. The real dollar value of the credit depends on your province of residence, but generally runds around 20% (15.5% Federal + provincial amount). So if the full amount is transferred to your husband, assuming he has a higher income and can utilize the tax credit it can mean approximately $1,300 back in taxes.





The disability tax credit is a non-refundable tax credit, so receiving money back from it is fully dependant on having sufficient income to utilize it and having paid taxes in the year.
